DID YOU KNOW … FIRST APPEARANCE FEES WHEN SUBMITTING A STIPULATION

When submitting a Stipulation and Order, if one of the parties listed on the stipulation has yet to appear in the case, the court will require First Appearance Fees for that party. Whichever party agrees to file the Stipulation and Order will have to pay those fees at the time of filing. The court will not refund or defer these fees because they are legitimately due. It will then be the responsibility of the filing party to collect those fees from opposing counsel. This can be an awkward situation if these fees were not discussed by the parties ahead of time.

First Legal recommends that you check the court record prior to submission or confer with opposing counsel to ensure their appearance fees have been paid.
