DID YOU KNOW . . . CRC RULE 2.251 – ELECTRONIC SERVICE

CCP §1010.6. mandates that local court rules will determine electronic service for civil actions. Express consent or formal agreement between parties is not needed to accept electronic service of documents if the court has already ordered electronic service on a represented party. Accordingly, CRC Rule 2.251(c) states that when a party is required to file documents electronically, the party must also accept service of documents electronically. If the local court rules require electronic filing of documents, then service and acceptance of service electronically are mandated without a formal agreement between the parties.
