LPI Legal Terminology: Word of the Month

Per Stirpes – a method of dividing an estate (by the stem). If an estate is to be divided between two persons and one has died leaving three heirs, then one-half of the estate is given to the surviving person and the other half is divided among the heirs of the deceased person.

Amanda’s will specifies her estate is to be divided per stirpes among her three children, Alice, Sarah, and Omar. Alice has one child, George. Omar has two children—Hannah and Anita. If Alice dies, her portion will go to George, the next person on Alice’s branch of the family tree.
