Legal Terminology: LPI Word of the Month

Voir Dire

The term voir dire is French for “to speak the truth.”  It is the process where potential jurors from the venire (the panel) are questioned by the judge or the lawyers to determine their suitability for jury service.  The questions are used to determine if a prospective juror can be fair and impartial.  This process usually results in some prospective jurors being excused from serving on a particular jury.  The attorneys may also exclude a certain number of jurors without giving a reason.

Voir dire is also the preliminary questioning of witnesses, especially expert witnesses, to determine their competence to testify.
