Department 1 at the Stanley Mosk Courthouse operates as a Master Calendar Court for purposes of CCP § 170.6 in the trial assignments of personal injury cases. The Court maintains two lists of judges that are available to hear the personal injury trials. One is entitled, “Civil Judges Hearing Trials Assigned from Department 1.” The other is entitled, “Criminal Judges Hearing Civil Trials.” Both lists are posted on the Court’s website (from the home page, go to “Divisions” then click on “Civil”) (http://www.lacourt.org/division/civil/civil.aspx) and are periodically updated. If a personal injury case is assigned for trial to a judge that is on either list, then the parties have twenty (20) minutes after the matter is assigned to exercise a peremptory challenge pursuant to CCP § 170.6. Effective August 1, 2018, if a personal injury case is assigned for trial to a judge that is not on either list, then the parties have sixty (60) minutes after the matter is assigned to exercise a peremptory challenge pursuant to CCP § 170.6.
Additionally, effective August 1, 2018, the assignment of any personal injury case deemed “complicated” by one of the five Personal Injury Hub courtrooms and transferred to an Independent Calendar courtroom will be assigned for “all purposes except trial.” Further, Department 1 delegates to the judge of that Independent Calendar courtroom the authority to assign the personal injury case for trial to that Independent Calendar courtroom.
